Practice Area Overview:
Owen Gallagher is the Founder and President of Gallagher & Associates. Mr. Gallagher concentrates his practice in corporate and insurance matters including enterprise structure and mergers and acquisitions. He has spoken before a number of groups on insurance related matters, including: “Unfair Claim Practices and Chapter 93A” at the Eastern Claims Association; “Hazardous Waste Site Investigation” at the Conference of Special Risk Underwriters; “Corporate Counsel Privilege” at the International Claims Association; “Hazardous Waste Site Investigation” at the Insurance Environmental Liability Association.
Legal Experience:
Mr. Gallagher is admitted to the State bars in Massachusetts and Rhode Island, the U.S. District Court for the District of Massachusetts, the United States Supreme Court, the U.S. Court of Appeals for the First Circuit, and the Court of Federal Claims.
Litigation matters:
Experience with all aspects of litigation, with a focus on insurance and complex claims; lead counsel on over 30 jury trials involving personal injury, corporate govenance, breach of fiduciary duty, criminal defense including murder, insurance coverage and policy rating disputes.
Claim matters:
Experience with all aspects of insurance claims, first party and third party claims, bad faith and coverage actions, responsibility for legal management of, at its peak, 2000 cases assigned to law firm, direct responsibility for special assignment of problem bad faith or high value cases.
Underwriting matters:
Experience in underwriting issues, including manuscript policy drafting, standard policy drafting, specific endorsement drafting, premium disputes on retrospective and experience rate endorsements, receipts based and composite rated policies, direct and agency billing, premium financing, reinsurance treaties, facultative reinsurance, representing reinsurers and ceding carriers in reinsurance litigation and reinsurance arbitration.
Regulatory matters:
Experience in regulatory areas with particular emphasis on Massachusetts issues, directed formation of Massachusetts only automobile insurance company for a national carrier, appearances before the Massachusetts Insurance Department on auto group deviations under G.L. c. 175, Section 193R, experience with workers compensation assigned risk, experience with NAIC committees and task forces, legislative bill drafting, lobbying specific legislation.
Standard distribution (American Agency System) and alternative distribution matters:
Broad contacts in the agency system in Massachusetts and Rhode Island, experience with agency mergers and acquisitions, agency-insurance company contractual disputes, agency defaults, drafting model agency contracts for insurance companies, agency valuation, perpetuation planning, secured and unsecured lending to agencies by insurance companies, clusters, networks, and captive programs for agencies and associations.
Background:
Mr. Gallagher is a graduate of Boston University with a degree in Philosophy, and Suffolk University School of Law. Mr. Gallagher is a member of the Massachusetts and Boston Bar Associations, the Business Law Committees, the Massachusetts Bar Foundation, and is a Special Assistant Attorney General, having pioneered a pro bono project with the Massachusetts Attorney General’s Office for private insurance defense counsel to defend the state against tort suits.
